Indianapolis Security Guard Suing Company For Unpaid Wages

An Indianapolis security company is in hot water after being accused of owing thousands of dollars in unpaid wages to employees. C.G. Security of Indianapolis just had a lawsuit filed against it by one former employee, but the Unite Here service workers union is planning to seek class-action status to include many of C.G. Security’s employees as plaintiffs.

The employee who filed the five-page complaint, Ramon Silva of Indianapolis, said that C.G. Security assigned him to work as a security guard at the Hyatt Regency in downtown Indianapolis. He says that he worked from April 2011 until February 2013 and “was not paid for all the hours he worked and was regularly not paid the required overtime premium.” Silva’s starting pay was $7.50 an hour; after a while, he became a salaried employee and received $396 a week. He said his bosses switched him to salary because they didn’t want to have to pay him overtime for the extra hours he was working.

“I was by myself all night from 7 p.m. until 7 a.m., and sometimes longer,” said Silva. “Because they were paying me a so-called salary, I was not even making minimum wage.”

The owner of the company, Charles Guynn, said that, “Ramon was an exemplary employee, but we paid him what we agreed to pay him. If he is offered a position as a supervisor and he takes it, then he is not eligible for overtime.”
