Partlow v. Jerry Asher In His Official Capacity, As Howard County Sheriff

July 22, 2022: This unpaid wage lawsuit was filed in the Indianapolis Division of the United States District Court for the Southern District of Indiana.  The lawsuit alleges that correctional officers working at the Howard County Jail were denied regular and overtime wages.  Specifically, these employees were denied wages for their time spent in a “Roll Call” meeting at the beginning of each shift. These employees were required to report to work 15 minutes prior to their scheduled shift to participate in this meeting, but were not paid any wages for this time worked. Plaintiff seeks to represent similarly situated workers who have been denied regular and overtime wages as a result of these pay practices and policies.

February 17, 2023 Update: The Court granted the Parties’ Joint Stipulation to Conditional Certification and Proposed Collective Action Notice and Opt-in Consent Form. As a result, notice of this lawsuit was sent to all eligible employees, who have until May 9, 2023 to execute a consent to join form. At present, 19 current and former employees have filed their consents to join this collective action lawsuit.
