Beals v. Franciscan VNS Home Care, Inc.

January 23, 2023: This unpaid wage lawsuit was filed in the Indianapolis Division of the United States District Court for the Southern District of Indiana.  The lawsuit alleges that Franciscan VNS Home Care failed to properly pay overtime to its occupational therapists (“OTs”), physical therapists (“PTs”), speech language pathologists (“SLPs”) and registered nurses (“RNs”). Specifically, these employees are largely paid on a per visit basis, but were wrongfully classified by Franciscan VNS as exempt from being paid overtime.  As a result, these employees were denied overtime payments required under the federal Fair Labor Standards Act (“FLSA”).  Plaintiff seeks to represent similarly situated workers who have been denied overtime wages as a result of Franciscan VNS’s pay practices and policies.

At present, three current and former employees have filed consents to join this lawsuit.
