Update: Gold Seal Termite & Pest Control Overtime Lawsuit

Based on information we have received, the U.S. Department of Labor is close to concluding its investigation of Gold Seal's overtime practices.  The Law Office of Robert J. Hunt, LLC continues to represent several employees who allege that Gold Seal failed to pay them overtime and did not accurately reflect the number of hours they worked.   According to our clients, they often worked more than 50 or more hours per week.  Gold Seal's pay records do not show anything close to the frequency or number of overtime hours our clients claim they worked on a regular basis.  Our goal is to recover overtime pay for all of the hours worked.

In the near future, you may be offered the opportunity to participate in a settlement between the Department of Labor and Gold Seal.  It is entirely your choice whether to participate in this settlement.  The following are some questions you may want to ask:  (1) Am I being paid only for the hours shown in my pay records or will I have the opportunity to dispute these hours if I disagree with the hours provided by Gold Seal to the Department of Labor?; (2) Will I be receiving double damages as part of the settlement?;  (3) Will the settlement cover 2 or 3 years of backpay?

If you worked for Gold Seal Termite & Pest Control prior to January 2014 and were paid a "salary," your pay records may not accurately reflect all of the overtime hours you worked each week.  This means you may be owed more unpaid overtime than what will be offered by the Department of Labor settlement.  Through the overtime lawsuit currently pending in the United States Distrcit Court for the Southern District of Indiana, we are seeking backpay and double damages for a 3 year period.  Although there are no guarantees that the lawsuit will be successful, you may be entitled to a larger recovery than what the Department of Labor settlement will provide.

Please note, the District Court has not yet made any determination that Gold Seal violated the Fair Labor Standards Act or owes any unpaid overtime or damages.  In fact, Gold Seal has denied any wrongdoing.
